According to the Court, the couple - Giuseppe and Stefano - would have appointed the Mayor as the defendant and not the <i>Comune</i> (County) and this mistake could have been solved if the Mayor of Grosseto, Emilio Bonifazi (Democratic Party), had appeared before the Court. </span><span style="font-family: Georgia, 'Times New Roman', serif;">Now the case is remanded to the District Court of Grosseto.</span><br />

Il 25 giugno scorso, la Corte d'Appello di Denver del 10° Circuito degli Appelli (d'ora in poi solo 10° Circuito) aveva deciso in favore di quelle coppie gay e lesbiche che l'anno scorso avevano iniziato un'azione legale contro il divieto al diritto al matrimonio nello stato dell'Utah. Se vi ricordate, il 20 dicembre 2013 il giuidice federale Shelby aveva accolto la richiesta delle coppie (<a href="http://sblog.s3.amazonaws.com/wp-content/uploads/2013/12/Kitchen_et_al_v._Herbert_et_al_12-20-13.pdf">qui</a> la decisione), ed ora il 10° Circuito ha confermato la sentenza del giudice Shelby (<a href="http://sblog.s3.amazonaws.com/wp-content/uploads/2014/06/10th-CA-on-marriage-6-25-14.pdf">qui</a> la sentenza d'appello); quello che manca è un'ulteriore appello alla Corte Suprema.<br />
<br />
Fino a qualche giorno fa - per la precisione il 9 luglio - lo stato dello Utah aveva avuto la possibilità di appellarsi nuovamente al 10° Circuito e, questa volta, tutti i giudici di questo Circuito avrebbero potuto prendere parte al caso <i>Kitchen</i> (questo tipo di giudizio prende il nome di <i>en banc review</i>). Così non è stato. Il 9 luglio lo stato dello Utah <a href="http://www.reuters.com/article/2014/07/09/us-usa-gaymarriage-utah-idUSKBN0FE27U20140709">ha detto</a> che avrebbe preferito chiedere alla Corte Suprema di rivedere il caso. E così sarà.<br />
<br />
Ma da ieri, i tempi per appellarsi si sono accorciati. Gli stessi giudici che avevano presediuto al caso Kitchen - Kelly, Lucero e Holmes - hanno ordinato allo Utah di riconoscere quei 1308 matrimoni che sono stati celebrati tra il 20 dicembre e il 6 gennaio 2014 (<a href="http://sblog.s3.amazonaws.com/wp-content/uploads/2014/07/Utah-10th-CA-temporary-stay-re-recognition-issue-8-11-13.pdf">qui</a> l'ordine). Facciamo un passo indietro. Se ricordate ancora, dopo che la Corte suprema aveva bloccato il prosieguo delle nozze, lo stato dello Utah aveva detto che a quelle coppie, che avevano celebrato le nozze in quell'intervallo di tempo, non sarebbero stati riconosciuti i benefici che già vantavano le coppie etero sposate (ad esempio non possono: fare la dichiarazione dei redditi insieme, prendere decisioni sulla salute del proprio coniuge, e così via). Da questo è nata una seconda azione legale, volta però a riconoscere a quelle circa 1308 coppie gli effetti giuridici dei propri matrimoni. In seguito il giudice Kimball <a href="http://www.sltrib.com/sltrib/news/57963402-78/state-sex-utah-judge.html.csp">si era espresso</a> a favore delle coppie, dando però, qualche giorno di tempo allo stato dello Utah per appellarsi. Ora - e di nuovo - il 10° Circuito ha deciso in favore delle coppie, dando allo stato dello Utah appena 10 giorni di tempo per appellarsi e per ottenere una sospensione del dispositivo della sentenza.<br />
<br />
<a name='more'></a>La palla passa ora alla Corte Suprema (d'ora in poi, la Corte). Lo stato dello Utah chiederà alla giudice Sonia Sotomayor la sospensione del dispositivo, ma, essendo la Corte nel periodo di "vacanza" (<i>recess</i>, in inglese), l'ordine di sospensione potrebbe anche non arrivare - e quindi i 1308 matrimoni verrebbero riconosciuti. Allo stesso tempo lo Utah chiederà alla Corte di rivedere il caso <i>Kitchen</i>.<br />
<i><br /></i>
Nei prosismi giorni il procuratore generale delloUtah, Sean Reyes, dovrà presentare alla Corte una petizione per un <i><b>writ of certiorari</b></i>. Con questo scritto verrà chiesto alla Corte di rivedere il caso <i>Kitchen</i>. La petizione verrà vagliata dai cancellieri della Corte che poi rifererano ai giudici se accettare o meno di rivedere il caso. A fine settembre i giudici cominceranno a riunirsi, e forse proprio nella prima riunione (<i>conference</i>) avremo la risposta dei giudici.<br />
<br />
Le risposte potranno essere solo che due: <i>certiorari denied</i> o <i>certiorari granted</i>. <i><b>Certiorari</b></i>, da latino, significa "più informazioni". Se accetterà - <i>certiorari granted</i> - di rivedere il caso, la Corte chiederà "più informazioni" sul caso. Verranno stabilite le date per presentare le memorie (<i>to file a brief</i>) di tutte e due le parti ed infine la data dell'arringa (<i>oral argument</i>). Poi la Corte pronuncerà la decisione.<br />
<br />
<b>Utili teorie cospirazioniste </b><i> </i><br />
Quello che deciderà la Corte è un mistero. Nessuno di noi sa cosa succederà, ma da bravi <i><a href="http://en.wikipedia.org/wiki/Legal_realism">legal realist</a></i>, i giuristi americani si divertono a fare pronostici.<br />
<br />
<u>Teoria n.1</u><br />
La Corte accetterà il caso, verrà stabilita la data per l'arringa - marzo 2015 - e a giugno la corte si pronuncerà.<br />
<br />
<u>Teoria n.2</u><br />
La Corte accetterà il caso - o rimanderrà la decisione <i>sine die</i> - , ma non verrà stabilita una data per l'arringa fino a quando le altre corti federali d'appello non avranno terminato di pronuciarsi su casi simili. Qui si potrebbe arrivare anche al 2016, anno di elezioni.<br />
<br />
<u>Teoria n. 3</u><br />
La Corte non accetterà il caso - <i>certiorari denied</i> - confermando la sentenza del 10° Circuito. Nello Utah saranno legali i matrimoni anche per le coppie gay e lesbiche. <br />
<br />
Queste erano le teorie in merito alla procedura da seguire. E invece quelle sugli umori dei giudici a solo sentire parlare di nozze gay?<br />
<br />
<u>Teoria della Vittoria</u><br />
Una maggioranza dei giudici dichiara illegittimo il divieto al matrimonio egualitario dello Utah. Di conseguenza tutti gli altri saranno illegiitimi. Tutti gli Stati dell'Unione dovranno consentire alle coppie dello stesso sesso di sposarsi.<br />
<br />
Di portata epocale, una sentenza del genere verebbe sostenuta dalla stessa maggioranza del caso <b>USA v. Windsor</b>: giudice estensore, il repubblicano Anthony Kennedy, seguono i giudici democratici, Ginsurg, Sotomayor, Kagan e Breyer.<br />
<br />
<u>Teoria della Sconfitta</u> <br />
Una maggioranza dei giudici sostiene la costituzionalità dei divieti. Qui è difficile ricostruire la composizone della maggioranza.<br />
<br />
<b>Una lettura delle teorie</b><br />
Quello che ho appena ricostruito è un possibile sistema delle più affascinanti teorie che circolano in giro. Personalmente sono dell'idea che, per quanta riguarda la procedura, verrà seguita la teoria n.2. I giudici vogliono vedere come i loro colleghi di grado inferiore gestiranno questa "patata bollente", e, fino ad ora, tutti i tribunali federali, a cui è stato chiesto di considerare la costituzionalità dei divieti, si sono espressi a favore delle coppie gay e lesbiche. Comunque la giustizia americana sa essere veloce. Entro dicembre avremo altre sentenze (dopo dicembre è troppo difficile che la corte accetti di rivedere un caso entro maggio).<br />
<br />
A breve lo stesso 10° Circuito dovrà esprimersi nel caso <i>Bishop</i> (Oklahoma) così anche il 4° Circuito nel caso <i>Bostic </i>(Virginia), il 6°, invece, sentirà le argomentazioni in diversi casi in agosto e così anche il 9°, invece, a settembre. Il 5° Circuito deve ancora decidere quando sentire il caso <i>De Leon</i> (Texas). Negli altri circuiti, invece, una sentenza di primo grado deve ancora arrivare oppure non arriverà mai, come per il 1° e il 2° dove già tutti gli stati riconoscono il matrimonio egualitario. <br />
<br />
Per quanto riguarda la decisione che i giudici prenderanno per ora è solo nebbia. Some years after their marriage, Alessandro realized to be a woman and decided to transition to the female sex. According to the Italian law Alessandro became Alessandra in 2009. Later the couple discovered that the county clerk of the place where they married, Finale Emilia (Emilia-Romagna), dissolved their marriage because the couple was in a same-gender marriage. So the couple asked the Civil Court of Modena to nullify the act of the county clerk and the court sided with the couple on October 27, 2010. Afterwards the Italian Ministry of Interior appealed the Civil Court decision to the Court of Appeal of Bologna and this time the court reversed the trial decision.</span><br />

<span style="font-family: Georgia, Times New Roman, serif;">Now it's time to consider why the Constitutional court was asked to intervene. Let's start from some decades ago. </span><br />
<span style="font-family: Georgia, Times New Roman, serif;"><br /></span>
<span style="font-family: Georgia, Times New Roman, serif;">In 1982 Italy became the third state in the world to recognize the right to transgender people to change their legal gender (<a href="http://www.t-girl.it/1-dis/1.6-leg/1.6.1-legge_164-82.htm">Gender Recognition Act 1982</a>). Before Italy, only Sweden (1972) and Germany (1980) provided such a right. </span><br />
<span style="font-family: Georgia, Times New Roman, serif;"><br /></span>
<span style="font-family: Georgia, Times New Roman, serif;">Even though it did not oblige transgender people to undergo a sex reassignment operation</span><span style="font-family: Georgia, 'Times New Roman', serif;">, the Gender Recognition Act 1982 was interpreted to do otherwise. </span><span style="font-family: Georgia, Times New Roman, serif;">Recently some courts allowed trans people to amend their gender and their name before a sex reassignment operation.</span><br />
<span style="font-family: Georgia, Times New Roman, serif;"><br /></span>
<span style="font-family: Georgia, Times New Roman, serif;">When Sweden and Germany make possible for trans people to change their legal gender, these country considered the case of a married trans person. Sweden and Germany chose to require to married trans people to divorce before to obtain a gender change recognition. However, Italy traveled a different path. The Act of 1982, art.4, stated that when a court orders the recognition of the change in gender of a person, the order cause the dissolution of the marriage of the person (or the "cessation of the civil effects" of Roman Catholic marriage). The same article clarifies that dissolution of the marriage of a trans person who changes his or her legal gender should be done according the Divorce Act 1970.</span><br />
<span style="font-family: Georgia, Times New Roman, serif;"><br /></span>
<span style="font-family: Georgia, Times New Roman, serif;">Now it comes the problem. In 1970 Italy established for the first time the possibility to divorce. Then in 1987 that Act was amended to cover the case of trans people. But the new law (which is still in effect) deals with only the case of a married trans (or his or her spouse) that wants to divorce. Now the problem: What happens if nobody wants to divorce? The laws nothing say about that. </span><br />
<span style="font-family: Georgia, Times New Roman, serif;"><br /></span>
<span style="font-family: Georgia, Times New Roman, serif;"><b>Italian Constitution rejects same-sex marriage (or something like that)</b></span><br />
<span style="font-family: Georgia, Times New Roman, serif;">In an unexpected speed the Italian Constitutional Court delivered the decision (sentenza 170/2014) on the Bernaroli case the day after having heard the arguments. This could prove that what the justices has written is flawed. </span><br />
<span style="font-family: Georgia, Times New Roman, serif;"><br /></span>
<span style="font-family: Georgia, Times New Roman, serif;">In fact the High Court wrote that the heterosexuality is required for Italian marriage laws, and that if a married trans person change his or her legal gender his or her marriage this would be incompatible with the constitution. So marriage equality seems that won't be a reality in the near future. </span><br />
<span style="font-family: Georgia, Times New Roman, serif;"><br /></span>
<span style="font-family: Georgia, Times New Roman, serif;">But in that opinion the court seems to have created a "law monster". The court assumes that even though this couple has become same-gender they can't be treated as a homosexual union because they were an opposite-sex couple once. So if the Parliament would have time to legislate on this issue it could keep marriage for heterosexual couple, create civil unions for gay and lesbians couples, and finally create registered partnership for people who are in the case of Bernaroli and her spouse (!). </span><br />
<span style="font-family: Georgia, Times New Roman, serif;"><br /></span>
<span style="font-family: Georgia, Times New Roman, serif;">Finally the worst thing of this decision. We said that Bernaroli marriage can't be considered a marriage, as we already said, but at the same time the couple should be recognized. But how? The Parliament should regulate - the court writes - their partnership in an alternative way as of marriage. So Bernaroli and her spouse can wait for decades if we wait the Italian Parliament. </span><br />

In 2012 this court rejected their appeal but delivered a landmark opinion for LGBT rights. That Court said that the Italian laws should treat gay and straight couple equally. </span><br />

According to the judge the Italian Civil Code does not ban same-sex couples from marriage.<br />
<br />
The judge concluded that "It's undisputed that this marriage produces lawful effects in the State which was performed (New York, USA) and it is not against that laws".<br />

<span style="font-family: Georgia, Times New Roman, serif;">Le due parti (Deboer, la coppia lesbica e Snyder, il governatore del Michigan) hanno portato in aula alcuni testimoni. In difesa del divieto al matrimonio egualitario il governatore ha schiearato la crème de la crème: i sociologi Mark Regnerus e Loren Marks, l'economista Douglas Allen che ha sostenuto che i "gay vanno all'inferno" e la cancelliera della Contea di Oakland, Lisa Brown, che ha dichiarato che se il giudice Friedman dichiarerà incostituzionale il divieto sarà pronta ad emettere licenze matrimoniali anche per le coppie gay (!).</span><br />

<a name='more'></a><span style="font-family: Georgia, Times New Roman, serif;">Nel <a href="http://www.sciencedirect.com/science/journal/0049089X/41">numero di luglio 2012</a> (Volume 41, Issue 4) della rivista scientifica Social Science Research venivano presentati due scritti <a href="http://www.sciencedirect.com/science/article/pii/S0049089X12000610">uno</a> del sociologo Mark Regnerus e <a href="http://www.sciencedirect.com/science/article/pii/S0049089X12000580">uno</a> di Loren Marks, un altro sociologo. Questi due scritti - soprattutto il primo - rimettevano in discussione il benessere dei bambini nelle famiglie LGBT. Come vedremo, lo scritto di Regnerus non trattava in alcun modo di questo tema, mentre quello di Marks rivolgeva una critica agli studi condotti dalla prestigiosa APA (American Psychological Association).</span>
