Utah: Governatore Herbert, non riconosciamo i matrimoni gay

Il Governatore dello Utah, Gary Herbert, ha fatto sapere che lo stato non riconoscerà i matrimoni contratti.

All'iniziativa risponde Peggy Tomsic, l'avocatessa che segue il caso Kitchen : "Questa azione deludente e senza precedenti ferisce non solo i miei clienti, ma centinaia di coppie dello stesso sesso che si sono legalmente sposate, e quelle famiglie che si sono viste portar via la loro basilare protezione legale".

UPDATE : Ora le coppie possono adire in giudizio lo stato dello Utah per vedersi riconosciuta la validità dei matrimoni contratti in quei 17 giorni.

41% of Italians is in favor of marriage of same-sex couples, 49% says 'no' and a 10% do not know.







Civil rights are an urgent issue?

59% of Italians says 'no', 27% says 'yes'.




In another poll only the 2% of Italians says that Civil Unions should be considered as an urgent reform. Italians think that 'cut of the MPs salaries' (63%), 'work' (61%), 'lower taxes' (37%), 'a  new electoral law' (26%), 'immigration's reform' (6%) are more important than recognizing same-sex couples.

Herbert v Kitchen: Ok a Sospensione


UPDATE 7:47 Secondo Scotusblog le autorità dello Utah si stanno interrogando sul destino delle circa 950 coppie che si sono sposate. 

Oggi la Corte Suprema Americana ha emesso quest'ordine relativo al caso Herbert v Kitchen, sospendendo il dispositivo della sentenza e quindi impedendo alle coppie gay e lesbiche che vollesero d'ora in poi richiedere le licenze matrimoniali di farlo.

L'ordine arriva dalla Corte, non si sa se intera o divisa, ma comunque come previsto la Giudice SOTOMAYOR ha comunicato alla Corte il caso e quindi ha deciso. E' da ricordare che i matrimoni da poco contratti sono validi e il caso è ora in appello, alla Corte d'Appello del 10° Distretto.

La fase in appello verrà celebrata il più veloce possibile e se la corte d'appello deciderà in modo diverso dal giudice SHELBY, allora i matrimoni contratti nel lasso di tempo 20 dicembre- 6 gennaio saranno resi invalidi, ma sarà comunque possibile una richiesta alla Corte Suprema, che sicuramente accetterà per finalmente raggiugere la questione di costituzionalità del matrimonio tra persone dello stesso sesso.  
Comunque dovremmo aspettare altre decisioni in altri casi perchè la Corte si decida a giudicare, anche se è ipotizzabile una decisione già il prossimo anno.    

UPDATE: Un commento a caldo  
Con l'ordine emesso oggi, la Corte, proprio perchè nessun Giudice si espresso in modo negativo (in realtà non ci è dato saperlo), ha voluto secondo, Lyle, cedere la parola alle Corte Federali, che quest'anno saranno impegnate a trovare persuasiva una delle due parti (pro-gay o anti-gay) e quindi quando altre corti avranno deciso, la Corte potrà raggiungere finalmente la questione delle nozze gay nel suo completo (infatti, nella decisone Hollingsworth v Perry, caso California, la Corte si era fermata su questioni procedurali, impedendole di raggiungere la questione).

Oltre al caso Utah, ci saranno il caso Michigan (DeBoer v Snyder) e quello Pennsylvania (Whitewood v Corbett) che rispettivamente a febbraio e giugno cominceranno, mentre è possibile un giudizio sommario nei casi Virginia.

''We must be careful not to administer a vaccine against faith to them'', Pope Francis says about kids of gay couples

On Saturday January 4, 2014, the Italian Jesuit magazine, 'La Civiltà Cattolica', releases the interview which Pope Francis made before the Superiori Generali in November.

 At page 13, Pope Francis said about children of gay couples and divorced ones that these situations ''provide(s) us with new challenges which sometimes are difficult to us to understand'' (the Pope referred to a case in which a girl confided to her teacher that her mother's fiancé didn't like her)

Therefore Pope Francis questioned himself, ''How can we proclaim Christ to these boys and girls? How can we proclaim Christ to a generation that is changing?'', so he answered, ''We must be careful not to administer a vaccine against faith to them''.

Herbert v Kitchen: Prossimo passo, una decisione della corte

Quest'oggi, Venerdì 3 gennaio 2014, i respondents (le copppie gay e lesbiche) hanno presentato la contro-argomentazione alla richiesta di ottenimento di una sospensione, proposta dallo stato dello Utah l'ultimo dell'anno.

Secondo i respondents la Giudice deve rifiutare la richiesta di stay perchè "Windsor (case) ... strongly supports the conclusion that Respondents are likely to succeed on their claims that Utah's marriage ban violates their right to equal protection of the laws'.

Ora la Giudice SOTOMAYOR ha la possibilità di decidere da sola oppure far sapere alla corte intera (9 giudici) del caso e quindi decidere. E' facile che la Giudice condividerà con gli altri 8 Giudici il caso che poi decideranno. Comunque se la Giudice o la Corte accetteranno la richiesta (la 5° che lo stato dello Utah ha fatto finora) le nozze gay saranno bloccate e il processo continuerà nella Corte d'Appello del 10° Circuito. Se la Corte (difficile che solo la Giudice deciderà in senso negativo) non accetterà la richiesta le coppie gay e lesbiche potranno continuare a richiedere le licenze matrimoniali e il processo continuerà sempre in appello. Con il rifiuto della richiesta da parte della Corte verrà sposata la tesi per cui in appello lo stato perderà di sicuro e quindi quando la Corte nel 2015 (molto probabilmente) quando deciderà, lo farà sicuramente in favore di tutte le coppie gay e lesbiche degli USA.

Italy recap: Civil Union bill and Anti-Hate Speech bill

On Thursday the new elected secretary of the Italian democrats, Matteo Renzi, reaffirms his incoming agenda, the new electoral law, the Constitutional reform, a new Job Act and two civil rights reforms, the Illegal immigration and the recognition of same-sex couples ones. 

The Civil Union bill was introduced in the Italian Senate on December 19 by the PD Senator Andrea Marcucci (right) and received 15 cosponsors on the same day (14 of the PD party and 1 from the Mario Monti's party).

Yesterday, January 2nd, 2014, the same senators supporting the bill expressed their support for a vote by the end of the month.

The Justice Committee of the Italian Senate will restart to consider the Anti Hate Speech bill on Wednesday January 8. 
In protest of the bill which aims to forbid anti-gay and anti-trans speech the Italian chapter of La Manif pour tous announced a demonstration in Genoa on January 11. Protesters believe that the bill will legitimate the State's Attorney to prosecute against them because of their opposition to same-sex marriage and sames-ex adoption.

Herbert v kitchen: Regnerus study 'uses rigorous methodologies', AG says

Sean Reyes, the new Utah AG, claims that the Regnerus study (here) used more 'rigorous methodologies' than the precedent and 'small' ones.

On December 31, 2013, the Utah AG addressed an application (here) to Justice Sotomayor seeking a stay on injunction.

In a footnote (n°12 page 17) the AG writes, " A recent small body of research has suggested that there are likely to be no differences in child outcomes between children raised by married husband and wife couples and those raised by same-sex couples, but this research is based on non-random, non-representative samples with few participants (most with less 100 participants) ... More recent studies, using more rigorous methodologies and with larger samples, find significant between children raised by married mothers and fathers and those raised in others family structures, including those raised by same-sex couples. Mark Regnerus ... the New Family Structures Study."

It's interesting to note that even the Utah AG concludes that the 'recent small body of research' suggests 'that there are likely to be no differences' when, as Andrew Perrin remember us, "the APA and AAP reports conclude essentially that there is no evidence of systematic difference, and Marks and Regnerus treat this as if the reports conclude that there is conclusive evidence of lack of systematic difference."
